Terms and Conditions

As of November 2026. This is a translation for your convenience; only the German version is legally binding.

1. Scope and contracting party

  1. These terms and conditions apply to all orders placed in the online shop pokemonkarten.at.
  2. Your contracting party is Antalyse GmbH, Wienerstraße 1, 2440 Moosbrunn, Austria, FN 614039z, Landesgericht Korneuburg, VAT ID ATU79907228, e-mail: bestellung@pokemonkarten.at ("we", "us").
  3. A consumer within the meaning of these terms is anyone who does not buy the cards for their business (§ 1 KSchG). Provisions that apply to consumers only are marked as such. Differing terms of customers apply only if we expressly agree to them in writing.

2. Ordering and conclusion of the contract

  1. The presentation of the cards in the shop is not a binding offer but an invitation to place an order.
  2. How to order: you put cards in the cart, choose the delivery country and go to "Checkout". There you enter your contact and delivery details, accept these terms and click "Place order and pay". Until that click you can check and correct all entries; "Back to cart" lets you change what you order. You are then taken to our payment provider Stripe to complete the payment.
  3. By clicking "Place order and pay" you make a binding offer to buy the cards in your cart. From that moment we reserve the cards for 10 minutes so that you can complete the payment. Putting cards in the cart alone does not reserve them.
  4. The contract is concluded when we confirm your order by e-mail after receiving the payment (order confirmation).
  5. If you do not complete the payment within the reservation time, the reservation ends and the cards are released. If a payment arrives only after the reservation has run out, we accept your offer as long as the cards are still available. If they have been sold in the meantime, we do not accept the offer and refund the full amount to the payment method used without delay.
  6. The contract language is German. We store the contract text. With the order confirmation you receive the order details, these terms and the withdrawal instructions by e-mail; you can also view the order via the link in the order confirmation.

3. Cards, condition and pictures

  1. We sell single cards of the Pokémon Trading Card Game. For every card we state the language, condition, finish (for example holo or reverse holo) and, where applicable, the rating of a grading service. These details are part of the agreed properties of the card.
  2. The condition grades (Mint, Near Mint, Excellent, Good, Light Played, Played, Poor) are described in our condition guide: https://pokemonkarten.at/en/condition-guide. Signs of use that match the stated grade are not a defect.
  3. If there is no photo of the actual copy, we show a sample picture of the card, marked as such. The stated condition grade is then decisive. Print-related differences between copies, such as centring and colour tone, are possible.
  4. We are not affiliated with Nintendo, Creatures, GAME FREAK or The Pokémon Company. Pokémon and the names of the Pokémon are trademarks of their respective owners.

4. Prices, shipping costs and minimum order

  1. All prices are final prices in euros and include the statutory VAT.
  2. Shipping is free. If your order contains a card priced at more than € 20, we ship it insured and charge 10 % of the goods value for this, at least € 5. Orders with a goods value of more than € 500 cannot be shipped insured; they are sent with tracking at no extra charge. The shipping costs are shown in the cart and before you place the order.
  3. Each delivery country has a minimum order value for the goods. The delivery countries and minimum order values are listed on the page "Shipping and payment" (https://pokemonkarten.at/en/shipping-and-payment) and in the cart. We do not deliver to other countries.

5. Payment

  1. You can pay by credit or debit card, Apple Pay, Google Pay, EPS bank transfer or PayPal. Payments are processed by Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland). For payments with PayPal, PayPal's terms of use also apply.
  2. The purchase price is due when you order and is charged when you complete the payment.
  3. You receive the invoice by e-mail as soon as we ship your order.

6. Delivery and passing of risk

  1. We ship with Austrian Post to the delivery address you give. We usually hand your order to the post within three working days of receiving the payment. Postal delivery usually takes 1–3 working days within Austria and 3–6 working days to Germany. Should an ordered card unexpectedly not be available, we will inform you without delay and refund any amount already paid.
  2. For consumers: the risk of loss of or damage to the cards passes to you only when the cards are delivered to you or to a third party named by you who is not the carrier (§ 7b KSchG).
  3. The cards remain our property until paid in full.

7. Right of withdrawal

Consumers have a right of withdrawal of 14 days. Details, including the consequences of withdrawal, are given in the withdrawal instructions (https://pokemonkarten.at/en/right-of-withdrawal). You can also declare the withdrawal online with the function "Withdraw from contract": https://pokemonkarten.at/en/withdraw. You bear the direct cost of returning the cards.

8. Warranty

  1. The statutory warranty rules apply (for consumers in particular the Austrian Consumer Warranty Act, VGG). The warranty period is two years from delivery of the cards.
  2. Please report defects or transport damage by e-mail to bestellung@pokemonkarten.at as soon as possible, ideally with photos. Your statutory rights do not depend on this.

9. Liability

  1. We are liable without limitation for intent and gross negligence and for personal injury.
  2. We are not liable for slight negligence, except for personal injury and where mandatory statutory provisions, such as the Product Liability Act, provide otherwise.

10. Data protection

How we process your data is explained in the privacy policy: https://pokemonkarten.at/en/privacy.

11. Complaints and dispute resolution

Please send complaints to bestellung@pokemonkarten.at; we will reply as quickly as we can. We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board.

12. Applicable law and place of jurisdiction

  1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by the mandatory provisions of the law of the country in which they have their habitual residence.
  2. Actions against consumers resident or habitually staying in Austria must be brought before the court in whose district the consumer lives or habitually stays (§ 14 KSchG). For businesses, the place of jurisdiction is the court with subject-matter jurisdiction for 2440 Moosbrunn.
